Confidential Interim WTO Ruling Finds Ontario’s Renewable Energy Scheme Discriminatory

With a trade-dependent economy, the McGuinty government’s decision to undermine Ontario’s reputation for open trading is about as wise as most other aspects of its Green Energy Act.

This new setback for the Green Energy Act highlights a troubling element of Canadian federalism. As it was forced to defend the Newfoundland government’s abusive exercise of power in the confiscation of property from Abitibi some years ago, the federal government was, in this case, pressed into service defending Ontario poisonous protectionism dressed up in a cloak of green.
